Obama Birth Certificate Injunction Denied by the Supreme Court

The birthers' quest to prove Barack Obama's Hawaiian birth certificate is fake took one step forward and one step back today.

Two days ago, Philip Berg filed and "injunction pending the disposition of the petition for a writ of certiorari." Presumably, this was an appeal that the court put the brakes on Obama's inauguration until they have determined whether or not to even bother hearing his case.

Injunctions are only granted when the court sees the case as having merit and being likely to succeed. Berg would also have had to prove that irreparable harm would occur if the injunction were not granted. Justice Kennedy today rejected the appeal for an injunction.

On the upside for the birthers, the case was distributed for conference, so mark your tin-foil calendars! January 9 is when the court will decide whether or not to grant the case cert!
