Obama Birth Certificate Injunction Denied by the Supreme Court
The birthers' quest to prove Barack Obama's Hawaiian birth certificate is fake took one step forward and one step back today. Two days ago, Philip Berg filed and "injunction pending the disposition of the petition for a writ of certiorari." Presumably, this was an appeal that the court put the brakes on Obama's inauguration until they have determined whether or not to even bother hearing his case.
Injunctions are only granted when the court sees the case as having merit and being likely to succeed. Berg would also have had to prove that irreparable harm would occur if the injunction were not granted. Justice Kennedy today rejected the appeal for an injunction.
On the upside for the birthers, the case was distributed for conference, so mark your tin-foil calendars! January 9 is when the court will decide whether or not to grant the case cert!

Unbelievable, let it rest already! Obama is the next President, like it or not. If he were not born in the U.S. why would he run, why would the Democratic Party endorse him, why would he put himself and his family through all that's involved in running for President only to have it all taken away? I didn't vote for him, but the people have spoken and lets all just get ready for the new year with our new President and stop all this foolishness!

Veronica, don't be silly. "Most of us" believe that Obama was born in the US. If not, he is guilty of fraud and deserves to be prosecuted.
All it takes is one prosecutor to bring a case, and if there's not a single one who thinks this is worth pursuing, then I think foolishness is a good word to describe those who keep beating the drum.

There are so many other things we could be focusing on right now. I'd love to see people putting as much time and energy into positive endeavors that can really make a difference and help others.

Why don't these idiots find another cause that will help folks, like fixing the economy... The odds are that the US Supreme Court will end up tossing this suit out on it's ear... These idiots just don't get it....and are wasting the courts time and money. He was fairly elected my a majority of the voters and the US Government had OKED his birth certificate when he submitted his name in for the election process. This whole mess is a moot point and there is nothing to prove their case in the least that has turned up except in these idiots imaginations. Get over it. Stop wasting my tax dollars on this nonsense.

Anyone want to bet the over/under on comments this time? Vegas has the line at 2,400 comments. I really like the over here. Birthers will be bringing their "A" game this time and have home blog advantage considering the birth certificate poll results from last time. This time, unlike before, the birthers will have PROOF! Like, links to other blogs, online petitions, and things that are good for U.S. Americans and such.

There is no question in my mind that Obama will be innaugurated. The question remains: has he purgered himself frequently to accomplish this, and again as he takes the oath of office. What a horrible burden this would be for future generations of any race.

I agree, and if this where a civil trial the files would be Subpoenaed by the courts. It may have been brought to court on Circumstantial evidence or what you leftwingnuts call rightwingnut theories. Again I say if you have nothing to hide why hide it.

The problem with many of the civil suits was standing, and that makes sense -- if you see someone rob a bank and sue him over it, your lawsuit will likely be dismissed because you lack standing.
That's not a problem with criminal complaints, because the criminal justice system proceeds in the name of the people and does not have to establish standing in court.
But the criminal justice system has shown no interest whatsoever in this case, not the federal system nor those in any of the states. That's enough to convince me that there's no substance there.

If you do not support the case, then you do not need to read or respond to the article. I prefer a tin-foil hat to the suicidal KoolAid any day. If the blind sheep wish to believe he is obeying the Constitution, or worse, you don't care about our Constitution, then don't even click on the article. However, those of us opposed to an illegal alien having his finger on the button should stick together and continue our fight to force corporate media to acknowledge the facts of our cases.

It's not even that I believe he was born in Kenya. It's just the fact that he has locked down every bit of information about himself accept what the DNC has released. No other President has done so to my knowledge or was allowed to by the Media. With Obama it's "Did you have conversations with the Ill Governor about you seat" NO I DID NOT. Well there it is folks positive proof. "Did you have a relationship with Bill Ayers?" Nope. Well there then he had no relationship. I simply have no trust in the man if he show no trust in "We the People".
Which by the way should be the only STANDING that is required.
