Michelle Obama WAS NOT DISBARRED

• Thus rumor was DEBUNKED LAST YEAR just by virtue of going to the ARDO website. You however without doing your own research stated that Michelle was “forced by the courts to withdraw her license after only four years of practice [sic - practice]“, so I don’t know how much explaining I can do to shake you of this. But here goes and I have included the LINKS TO PROVE the FACTS.

In Illinois, the REGISTRATION OF and disciplinary proceedings affecting members of the Illinois bar has been delegated by the Illinois Supreme Court to a board called the Attorney REGISTRATION and Disciplinary Commission. The ARDC collects bar dues, administers an orientation program for newly-admitted members, and oversees the mandatory continuing legal education program.

Pursuant to Illinois Supreme Court Rule 756, annual bar dues and registration is required. An attorney may voluntarily transfer to involuntary status if he or she does not engaged in practice before the Illinois courts. Most often this statuts is sought when attorney moves to another state but wants to maintain Illinois bar membership; when an attorney retires; when he/she takes an in-house position and thus does not hold himself/herself out for legal representation of members of the public (when you are in house, you have only one client); or when the attorney takes a position in a non-legal field, but wants to retain the ability to return to the active practice of law.

The advantage of transferring to inactive status is that bar dues are only $90 annually (whereas for active members they are $239) (see Rule 756(a)(5); the inactive attorney is exempt from the minimum CLE (see Rule 791(a)(1); and he/she does not have to maintain a policy for professional errors and omissions (that’s malpractice insurance for you gringoes).
So what’s all this fuss about “court ordered” inactive status, you ask? Well, a visit to the ARDC’s website would answer that.

To summarize it for you, “Court ordered” refers to former Illinois Supreme Court 770, which applied to registration status PRIOR TO NOVEMBER 1, 1999. Under that former Rule, an attorney who wished to VOLUNTARILY transfer to inactive status had to petition the Court for an order allowing such. It was simply administrative — no hearing was required, just paperwork.
Michelle Obama left Sidley in 1993 to take a position in the nonprofit sector in 1993. Notice that the ARDC site shows she went to inactive status in 1993. In 1993, when former Rule 770 was the operative provision for transfer to voluntary inactive status, MO was required to petition for a court order. As should be obvious, the order was granted.
In short, there is nothing nefarious about Michelle Obama’s law license going inactive.
• As to a definitive explanation on the change of rules… Here is a quote directly from the IL bar site:
“Prior to November 1, 1999, former Supreme Court Rule 770 provided for a proceeding in the Court for any voluntary transfer to inactive status, whether because of some incapacitating condition or solely as a matter of the lawyer’s preference because the lawyer would not be practicing law.”

• One can also go to ARDC site and look at all disciplinary actions against all Illinois attorneys by year. I poured through all several hundred for that year, plus half a year on either side to be sure.
There has at no time been any disciplinary action taken against Michelle Obama and there is nothing nefarious about her law license going inactive.

Q: Did Michelle Obama make $317,000 a year while working part-time at the University of Chicago Medical Center?

A: This allegation in a chain e-mail is wrong: Obama’s reported income was $103,633 in 2007, the year she reduced her work schedule to part time.


On Jan. 9, 2009, the University of Chicago Medical Center officially announced that Michelle Obama had resigned from her post as vice president for community and external affairs to join her husband, then-President-elect Barack Obama, in the White House as the new first lady of the United States.

Michelle Obama had been promoted in 2005 to vice president for community and external affairs after three years as the executive director for community affairs. It’s true, as the e-mail (and National Review column) says, that she received a sizable pay raise that year. She went from earning $121,910 in 2004 as an executive director at the hospital to making $316,962 in 2005 as a vice president, according to tax returns filed by the Obamas for those years. But the suggestion made by the email’s author – and not made by the National Review – that she was being paid more than $300,000 for a "20 hour a week job" is not true.

University of Chicago Medical Center spokesman John Easton said Mrs. Obama didn’t reduce her work schedule from full time to part time until 2007 when it became clear that her husband would run for president. "As she reduced her hours, beginning early in 2007, her salary decreased proportionately," Easton told us in an e-mail. "She switched to half time shortly before her husband formally announced his campaign, then to 20% later that year and to 0% in 2008."

In fact, Mrs. Obama’s income in 2006, a year after her promotion, had decreased to $273,618. And for 2007 (the year she actually started working part-time), her income was $103,633, according to the couple’s tax return for that year. She took an "unpaid leave of absence to work on her husband’s presidential campaign" in 2008, but still received $62,709 from the hospital. However, Easton noted that her final reported salary "consists of accumulated but unused vacation time plus the final payout from a supplemental executive retirement plan."

Easton said the nearly $317,000 figure is "misleading" anyway because it includes more than just her salary. He said the figure "also includes a performance bonus, a one-time signing bonus (she had other, competing offers at the time), and a one-time mandatory payout from a terminated retirement plan." This is reflected in the fact that her 2006 earnings were less than in 2005.

The first lady, a graduate of both Princeton University and Harvard Law School, was quite accomplished before she joined the University of Chicago in 1996 and ultimately the medical center in 2002. Her prior work experience included stints as an associate with the Chicago law firm of Sidley Austin LLP, assistant commissioner of planning and development in Chicago’s City Hall and executive director of the Chicago chapter of Public Allies.

Here it is, word for word, as it appeared:

Let me add that Michelle's position was a part time, 20hr. a week job. And to think they were critical of Blagoyovich's wife for taking $100,000 in fuzzy real estate
