Drilling Ban: Appeals Court Rejects Moratorium on Deep-Sea Wells

The Obama administration's attempt to impose a six-month moratorium on deep-water drilling for oil in the Gulf of Mexico has suffered another setback in federal court.

A three-judge panel in New Orleans upheld a lower court Thursday, ruling that the Interior Department did not show the government would be hit with "irreparable injury" if the drilling ban is not imposed, the New York Times said. The lower court said it was arbitrary and hurtful to industry in a region where thousands of workers depend on energy companies for their jobs.

The government argued that the moratorium was needed while new safety standards are developed and also to allow time to get more emergency equipment into the region in the aftermath of the disastrous BP oil spill. Interior is now expected to rewrite the rules and issue a new moratorium, the Times said, citing an administration official. While the order was in place, work halted on 33 exploratory wells and new permits were suspended, but on-going production on more than 3,000 platforms was not affected.

Away from the courtroom, the Alliance for Justice disclosed that all three of the New Orleans appeals court judges had ties to the oil and gas industry. The liberal group said Judge Jerry E. Smith, as a lawyer in private practice, had represented Exxon Mobil, ConocoPhillips and Sunoco. Judge W. Eugene Davis and Judge James L. Dennis both have had investments in energy companies, the organization said.

The article mentions that the 3 judges had ties to the oil industry but the article neglects to mention that the commission that obama had investgating the spill and pushing for the drilling ban is made up completely of environmentalists and not one oil industry member. The judges have the law as their basis for their decision. Obama and his commission have an anti drilling agenda as the basis for their decisions. It's an insult to intelligent readers to try to make it appear that these judges are bought by the oil industry The claim that the government would be irreparably injured if the ban was not imposed was found to be without merit. Seems like the government was poorly prepared to present their case.

It is becoming clearer each day that our court system, like our political system, is rotten to the core. Senator Byrd was right, The political money system is "rotten, it is putrid and it stinks." All of those appelations can now clearly be applied to the court system. I don't remember who I heard call the reactionaries on the Supreme Court the "Rats Pack" but the "shoe certainly fits." Now we have an oil soaked appeals court, as black and shiney as the wildlife in the Gulf, ruling in favor of the despoilers of the planet. Apparently it matters little that those dependent on the Gulf have been destroyed financially as long as Big Oil is allowed to rape the planet.

The Gulf represents 10% of the U.S. GDP , so shutting down drilling would hurt the economy nation wide. Some blame has to fall on Government inspectors , and why is there hardly any press on the Government red tape that has been hampering clean up and animal rescue since day 1. We all know the current administration could cut through this red tape anytime they want...so what gives?

There were already safety standards and regulations in place when this happened. It was not only BP's fault, but also our own present government for the failure of waiving safety inspections on this rig for months. This spill has gotten so out of hand because of government lack of intelligence on how to handle this. Not accepting the help that was offered right from the beginning when a wavier of a bill by the president could have stopped alot of the oil from reaching our shores. This to me was just an outright ploy of this administration to push personal agendas. We could be drilling for oil on land but our government is blocking any permits to tap our land based oil reserves. Pure political moves to push through agendas like cap and trade which will ruin our economy. Yes this was a tragic accident, but stopping all of the drilling will only put more of a burden on this country to but more foreign oil. This administration cannot get it through their head that when these rigs pull out and move to another country they will not be back. My gratitude to these Judges for standing up for the people's right to work, when our president was more worried about playing golf.

This blowout happened in 1979 in 100 ft of water and it took 10 months to fix. If you cant contain it or fix the worst case scenario then you dont drill. This spill should be a lesson to remind us that these things happen. The oil companies while making record profits has relaxed the standards instead of making it more safe to drill. Lets thank Mr Cheney for helping with those record profits at our economic expense as well as the environmental cost.

So what that anyone has invested in gas and oil? When it was ok to invest in what you wanted it didn't matter. I have investments in alot of areas, that's my retirement plan. Does that make me biased and evil?
