Conservatives Step Up Attacks on Kagan: 'It's Not Over Till It's Over'

The success of Elena Kagan's path to the U.S. Supreme Court comes down to numbers. Twelve Democrats and seven Republicans sit on the Senate Judiciary Committee that will take up her nomination Tuesday morning.

In the full Senate, Kagan's nomination will go before a heavily Democratic chamber, where Democrats will outnumber Republicans, 59-41. With 60 votes needed to move her nomination forward, at least two Republicans, Maine's Olympia Snowe and Susan Collins, have praised Kagan in the past and are poised to make the 60-vote threshold easy for Kagan to reach.

But despite the smooth sailing Kagan is expected to have in the Senate, conservative groups have ramped up an aggressive opposition to the nomination in recent days, holding rallies, beefing up such Facebook pages as Stop Kagan, circulating a petition against Kagan at IOpposeKagan.com, and individually urging their members to call senators to keep Kagan off the high court.

"Politics is a game of numbers, but it's also about momentum," said Dr. Charmaine Yoest, the president and chief executive of Americans United for Life, a pro-life advocacy organization that opposes Kagan. "You never know what's going to happen. It isn't over until it's over."

Yoest and her 20-plus staff began working around the clock to stop Kagan's nomination even before President Barack Obama nominated her to succeed the retiring Justice John Paul Stevens, assuming Kagan would be his choice. After her nomination, AUL's legal team produced a background paper on Kagan's record every day until the Senate Judiciary Committee's hearings on Kagan, where Yoest testified against the nomination.

On Monday, AUL worked with former Surgeon General C. Everett Koop to send a letter to all 100 senators calling Kagan's past conduct on abortion issues "unethical and disgraceful."

"We have a moral imperative to make sure people know the facts before the vote is final," Yoest said.

Beyond the abortion issue, Kagan has generated conservative opposition from pro-military organizations, pro-business lobbyists, Tea Party groups and the National Rifle Association.

In an urgent action alert, the NRA called on members Friday afternoon to lobby their senators to filibuster Kagan, based on what the group says is Kagan's past opposition to Second Amendment rights. "The NRA also pointed to Sonia Sotomayor as a reason to oppose President Obama's second nominee, accusing Sotomayor of "deliberately misleading the American people" about her beliefs about the Second Amendment during her own nomination hearings in 2009.

And instead of simply relying on members to call their senators, a Tea Party group in South Carolina put the heat directly on Sen. Lindsay Graham, the only Republican on the Judiciary Committee last year to support Sonia Sotomayor.

"Senator Graham, if you vote 'yes,' the voters will not forget it," Benjamin Smith of Move America Forward warned Graham at a rally last week, calling Kagan "un-American."

Before the this latest conservative blitz, 14 Republican senators had already announced they'll oppose Kagan, including Senate Minority Leader Mitch McConnell and Sens. John McCain of Arizona, Lisa Murkowski of Alaska and Orrin Hatch of Utah.

But those numbers will surely grow. Sotomayor saw 31 Republicans oppose her nomination, with just nine GOP members (including Maine's two senators) supporting her.

A window into Republican opposition to Kagan may come from a recent Gallup poll, which shows that the partisan divide in the Senate over Kagan reflecting a similar partisan divide in the country. Gallup found that a majority of self-identified Democrats, 68 percent, favor Kagan's confirmation, while 21 percent of Republicans do.

Overall, Gallup found Kagan's approval rating among the public at 44 percent, the lowest of any potential Supreme Court justice who went on to be confirmed. Harriet Miers had a 42 percent approval rating before President George W. Bush pulled her nomination. Chief Justice John Roberts had the highest rating of any recent justice -- 60 percent -- while the Senate considered him for the court.

After the full Senate votes for her nomination, some time before the chamber's August break, Kagan will be sworn into the court, giving her about two months to hire a staff and prepare for the court's opening session in October.

Yoest said that AUL is just getting started in its work against Kagan and will eventually score a vote for Kagan by any senator "as a vote against life."

"We intend to hold every single senator who votes for her responsible for that vote," Yoest said. "For the woman who appears to have been single-handedly responsible for extending the reign of partial birth abortion for a full decade in this country, this is not a vote any senator can take a pass on."

This is about conservative politics, not about Kagen. Don't try to dignify the blogs with anything about her not being qualified, must be someone better qualified. The agenda the conservatives have is to elect fundamentalist justices to the Supreme Court. Because the President nominated her, she is the enemy. It's that complicated, and that simple. Kagen will be a great justice. Thomas has shown he is not. Fundamentalism is not the be all and end off way to evaluate a justice.

..yes she's very smart. She was the Solicitor General, a prestigious position. On the other hand she never tried a case, no decisions there, where is the paper trail on her judgment?? This job is for LIFE. It shouldn't be about party it should be rather that she is the very best for the job.

Once again Republicans are showing us how adept they've become for laying down on the job; some of yous may even think it's cute, trouble is, when they were sent to Washington, it was for the sole purpose of legislating laws for the good of the nation and our people.
Now a good many of yous are warming up to reward these fleecers to the nation and our people, by re-electing 'em for another term.
Be careful cuz, you might just get what yous been wishing for.

A note of thanks to Jeffrey Weiss for a novel word. I am new here so please, be kind. Something bugs me; what exactly does Eric Holder mean when he calls the USA a nation of cowards ? Truly,I really am curious as to what he is thinking. Can we kick around a civilogue on thorny issues ?

It would seem all these one-issue groups are banding together for no other reason than to show negativity toward Obama (again). This woman not only seems fair-minded but also able to change her mind about issues: just the type of anti-dogmatic flexibility needed as a supreme court justice. Give up your cause, people! Most American women agree Roe vs Wade must remain the law, if only because their bodies are ONLY theirs to control as they please. That abortion is morally wrong remains personal conviction--but Man's law must trump God's to maintain fairness and order. If these groups wanted to make sure Rep Stupek's sacrifice was not in vain, petition Obama to keep his promise to NOT fund abortions from health-care insurance.

Bork drove his own car off the end of the pier in the hearings. He showed himself to not only be extreme, but unstable. He created a verb, being Borked, by what HE said and did.

I'm not sure what this article is about. It seems to be about Republican opposition to Elena Kagan's nomination, yet, the author states right in the middle of this that;"After the full Senate votes for her nomination, some time before the chamber's August break, Kagan will be sworn into the court, giving her about two months to hire a staff and prepare for the court's opening session in October."
So what's the worry? Is this an op-ed on the futility of being a Republican? What gives here?

Once again, REPUBLICAN = Obstruction

American Voters will NOT tolerate this. American voters want to move FORWARD, which is why we elected President Obama, and a Democratic controlled congress.

WHo would you people rather have on the court? Harriet Meyers?!??!!!??? That was the Republican choice, and that woman was just a friend of President Bush. Of course there is no comparison with Kagen because of her education, experience, and expert knowledge of law in this country. She is WELL suited to become the next Justice, which is why she will EASILY be confirmed.

The Republicans have ZERO to say about it, and they are just trying to get free publicity at this point, but hard working Americans are DONE with the GOP.
