But federal judges don't buckle to dares. And they rarely rush to endorse litigants who fail to present plausible (much less compelling) cases in their courtrooms. So for those of you just now tuning back in to this unfolding legal drama, Walker's landmark 136-page ruling Wednesday is not nearly as surprising as you might think. As he suggested he would during closing arguments, the judge, an appointee of the first President George Bush, wholly rejected the dubious rope-a-dope strategy employed by Cooper and Company. Indeed, if the trial and the ruling were a boxing match it would have been an early TKO. if god intended for two partners to be of the same sex he'd made it possible for the same sex to lay down and conceive.

There's something called the "social contract," which implies that the people will obey their government as long as government stays within defined limits. This judge has broken the social contract.

I know my life is not going to be adversely affected if two men, or two women wish to marry. To each his/her own. Believe what you will, but Jesus said "judge not lest ye be judged".

And in my opinion the definition of marriage should be left to the various cultures in which it is practiced. Meaning what 'marriage' means for one may not be recognized as valid by others. Freedom of religion Freedom of Speech is of utter importance and should be preserved. Equally important is the preservation of equal rights. In order to protect the freedoms our nation affords us and to provide equal rights to both gay and same sex couples, seperate the word "marriage" from equal rights afforded to marital union. Let the law recognize the joining of two people (heter or homo sexual) as civil unions. Let marriage be defined for the individual by the individual cultural beliefs. The law should not discriminate nor should it infringe on variety within cultural beliefs.

If you support the Bible then sex marriage is clearly wrong. America can come up with more reasons to go to court on! Like sueing because hot coffee burned you. Well coffee is HOT. I used to be vehemently against gay mairrage. But over time the more I thought about it. It really does'nt matter.

I have a brother who is gay. I still love him. He is my brother.
I would not care if he wanted to marry.
BUT...Be careful what you wish for. Divorce can be hell.
I don't hate Christians. I just don't like you thinking you should decide what is right or wrong for everyone. What I do hate is the denying of equal rights to a large segment of society based solely on who they love.
August 09 2010 at 11:29 PM Report abuse Permalink +2 rate up rate down ReplyI have to disagree with the praise heaped on Walker's ruling: from a constitutional law standpoint, it's one of the most shoddily written pieces of tripe I've ever read. Total fail on the rational basis test.
Other favorite moments: I particularly liked the part where he said that opposition to gay marriage is founded in a "fear or unarticulated dislike" of homosexuals on the part of Prop 8 supporters. If it's unarticulated, how does Judge Walker know it's there? (It certainly wouldn't be part of the testimonial record of the trial...) Is he now a mindreader as well as a really bad con-law practitioner? Or is he so convinced of his own righteousness that he simply cannot imagine a rational argument in opposition to his own, instead choosing to invent emotional motives out of whole cloth?
Most head-slapping moment of all: "moral and religious views form the only basis for a belief that same-sex couples are different from opposite-sex couples....this belief is not a proper basis on which to legislate." Well, conversely, then, moral and religious views also form the only basis for Judge Walker's belief that they are the same. This entire ruling is, in fact, based on a moral judgment in favor of homosexual marriage. Judge Walker, almost all law begins with a moral determination. We cannot simply start discarding laws whose underpinnings lie in accepted morality...there'd be no law left.
You can be glad or sad about the ruling...just don't say it's brilliantly written or that it's a slam dunk in the 9th circuit or the Supreme Court.
