NFL Asks Russ Feingold to Pull New TV Ad

Wisconsin Sen. Russ Feingold is out with a new TV ad that includes footage from NFL games to help make the case that his political opponents should be penalized for "dancing in the end zone" -- celebrating his defeat prematurely.

But according to the Milwaukee Journal Sentinel, the league has asked the Feingold campaign to take down the ad:

NFL spokesman Greg Aiello told the Journal Sentinel that the league did not license the footage used in the ad. He said the league had contacted the Feingold campaign about removing it.

The ad features various scenes of football players celebrating in the end zone. One clip shows the infamous 2005 "mooning" incident featuring Randy Moss, then with the Minnesota Vikings, in a game at Lambeau Field.

Update: Feingold has recut the ad to remove NFL footage.

Whilst I like Greg Aiello, the NFL has only the claim to control rebroadcast of the games and significant portions of them. The footage of celebrations is done clearly not during game play, which is all that they rightly can claim fair copyright to. Just as people can use fair use snippets of published works they can use fair use of pictorial representations...these are not single photos made in studios or by individual photographers. In point of fact there is no legal way to prohibit the commentary of any game by anyone under the First Amendment who wants to go to a venue and record on their own although they can try to prohibit importation of recording devices without license. Were I Feingold I would say-"sue me" and trust the NFL would have the brains to realize their plush anti-trust exemption is only allowed by grace of Congress in the first place.

Look at the history of Feingold. He is a party line voter. Back in Washington he is arrogant and ultra liberal. How can he have brought jobs and money to Wisconsin when the state unemployment is high and the state is broke.

I'm sure Russ 'tucked' away enough political contributions to help him ease into retirement. Good-bye you liberal leftist...... turn the light off when you leave the room. By the way, doing good things for Wisconsin does not give him a pass on the things he has done to the rest of us. If you love they way he worked for your state, then elect him to a State position.

another PD article that does not mention a Democrat's party affiliation when the news is not good. on PD, if Feingold were Republican, that would likely have been mentioned once and his Republican connections would have been highlighted as a clumsy sort of reinforcement.

Hey "bpdarling", typical liberal bs your spouting there. Bragging about how much "Money Money Money" Findgold has brought into Wisconsin. Well buddy, it is OUR Money Money Money that Feindgold and his liberal cohorts in Washington DC have stolen and earmarked back to Wisconsin. Our money hijacked just to try and buy the votes of any so called American that is low enough, or slow enough, to support the liberal democrats "steal and deal" type politics. I would much rather send an established businessman to DC that has actually made money and created jobs in the real world.

He should have used the "Hail Mary" pass as his ad. Russ Feingold is history. He will probably lose by double digits. The people of Wisconsin are finally realizing what a left-wing loon this guy really is. I'll tape his concession speech for you, along with all the other liberal icons as they shed many tears. The 2010 midterms will make 1994 look like a victory for the democrats.

It seems to me that the NFL has become so in love with itself that it is in the process of killing the game. Requiring permission to show brief instances of things that occured before millions of people is absolutely ludicrous. This is not a replay of the game for profit and I can see no loss for the overinflated egos of the NFL. One thing is sure, ticket prices have become so outrageously expensive that only wealthy individuals and corporate tax writeoffs can afford seats.... cutting the throat of the very people that make the game what it is today.

Some lawyer. Illegally pirating NFL footage for use in his own political ads. Either, Russ doesn’t understand, or he chooses to ignore, the NFL’s constitutional right of private ownership. Concepts any first year law student should know. If the NFL sues, and wins, who pays? Russ or the taxpayers of Wisconsin?

DO you just automatically write this stuff for EVERY Democrat? You probably don;t even know who Senator Feingold IS!!! I worked on his campaign, and he has brought more MONEY MONEY MONEY into the State of Wisconsin (oh, and JOBS TOO!!) than any recent legislator. His opponent of course is a wealthy "businessman" who is FAR right to the point of lowering the minimum wage and OUTSOURCING jobs to foreign countries. Senator Feingold has been a LEADER in the Senate and HAS followed the rules. I hope you now have your FACTS straight. have a nice day.
