Final Arguments Made in Proposition 8 Trial

Final Arguments Made in Proposition 8 Trial

SAN FRANCISCO (June 17) -- Attorney Charles Cooper made his final argument that California's ban on same-sex marriages should be upheld as constitutional by telling Chief District Judge Vaughn Walker: "Your honor, you don't have to have evidence for this." The judge appeared mildly surprised. But Cooper's novel argument was in keeping with the minimalist defense he and his legal team mounted to uphold Proposition 8, which outlawed same-sex marriage in 2008. During the trial phase in January, the defense called only two witnesses. In his closing argument Wednesday, Cooper made the case that ...

Washington Post Reporter's 'Bigots' Tweet Criticized by Right

When The Washington Post recently hired blogger Dave Weigel to cover the conservative movement and the GOP, one right-leaning site, Newsbusters, was not impressed. "The paper has hired another blogger who has been critical of the Right," it wrote, "and his beat will be, you guessed it, covering conservatives." Now, a Tweet Weigel sent out Saturday has confirmed conservatives' fears. While much of official Washington was preparing for the White House Correspondents' Association dinner, Weigel sent out the following Tweet: "I can empathize with everyone I cover except for the anti-gay marriage ...

Gay-Marriage Backers Lose Bid for Spot on Calif. Ballot

Gay-Marriage Backers Lose Bid for Spot on Calif. Ballot

LOS ANGELES (April 12) -- Gay-rights advocates' push to qualify a November ballot initiative legalizing same-sex marriage in California has fallen short, as it failed to gather the 700,000 petition signatures required by today's deadline. The group Restore Equality 2010 had sought to repeal California's controversial Proposition 8, which voters approved in November 2008 in response to a California Supreme Court ruling that gays and lesbians have the right to marry under the state constitution. Proposition 8 changed the state constitution to define marriage as only between a man and a ...

Actors Re-enact California Gay Marriage Trial for YouTube

The U.S. Supreme Court blocked video coverage of the trial challenging California's gay marriage ban, but two Los Angeles filmmakers have found a clever way to publicize the proceedings. They've hired actors to re-enact all the arguments and testimony of the trial. In the days after the high court ruling, John Ireland and John Ainsworth began "The Perry vs. Schwarzenegger Trial Re-enactment." They told AOL News their motivation was to let members of the public hear the arguments firsthand and decide for themselves whether the right to marry should be extended to same-sex couples. The cast of ...

Testimony Ends in California Same-Sex Marriage Case

Testimony Ends in California Same-Sex Marriage Case

Testimony in the legal challenge to California's Proposition 8 ended Wednesday with attorneys for the gay couples who are plaintiffs in the case expressing confidence the judge will rule in their favor, the Los Angeles Times reports. Defenders of Proposition 8 -- a ballot measure passed by voters in November 2008 that limited marriage to opposite-sex couples -- conceded that they may have to wait for a higher court to uphold the state's ban on gay marriage. Vaughn Walker, the judge in the case, is a Republican with libertarian views who is expected to favor the challengers. He could rule as ...

Supreme Court Keeps Cameras Out of California's Gay Marriage Trial

Supreme Court Keeps Cameras Out of California's Gay Marriage Trial

The U.S. Supreme Court has blocked video coverage of the trial challenging California's gay marriage ban. In a 5-4 decision late Wednesday the justices said U.S. District Judge Vaughn Walker failed to follow the proper procedures for allowing cameras in the courtroom, the Los Angeles Times reported. When the trial began Monday, the high court temporarily barred Walker's decision to allow the proceedings to be televised and streamed on the Internet. Wednesday's ruling makes the ban permanent. The Supreme Court did allow streaming to other rooms of the San Francisco courthouse where the ...

Gay Marriage Goes on Trial in California, Without Cameras Rolling

Just as California's trial on gay marriage got under way today, the U.S. Supreme Court temporarily overruled a federal judge in San Francisco and barred video coverage the proceedings. Without explanation, the justices blocked the decision by U.S. District Judge Vaughn Walker allowing the trial to be streamed on the internet, the Los Angeles Times reported. The Supreme Court did allow streaming to other rooms of the San Francisco courthouse where the trial is being held. The temporary order will remain in effect until Wednesday. Lawyers for supporters of Proposition 8, which banned same-sex ...

Landmark Gay Marriage Trial Kicks Off

SAN FRANCISCO (Jan. 11) - The first federal trial to determine if the U.S. Constitution prohibits states from outlawing same-sex marriage got under way Monday, and the two gay couples on whose behalf the case was brought will be among the first witnesses. The proceedings, which are expected to last two to three weeks, involve a challenge to Proposition 8, the gay marriage ban approved by California voters in November 2008. Regardless of the outcome, the case is likely to be appealed to the U.S. Supreme Court, where it ultimately could become a landmark that determines if gay Americans have ...

Gay Marriage in Argentina Could Escalate Global Fight

Gay Marriage in Argentina Could Escalate Global Fight

(Dec. 30) -- On Monday, two Argentinian men became the first gay couple in Latin America to legally wed. But even as advocates celebrate that milestone, opponents of gay marriage are digging in to blunt the movement's global momentum. The wedding between Jose Maria Di Bello and Alex Freyre in Tierra del Fuego, Argentina's southernmost province, was by no means an isolated victory for gay rights groups in Latin America. In 2002, Buenos Aires became the first Latin American city to permit same-sex civil unions. In 2007, Uruguay legalized civil unions for gay and lesbian couples. Ecuador did ...

Opinion: New Approach Needed to Advance Gay Rights

(Dec. 3) - In the immediate aftermath of the passage of California's Proposition 8 last fall -- where voters amended the state's constitution to recognize only marriages between one man and one woman -- there was a lot of finger-pointing in the gay community, but no bloodletting. Leaders of all the major gay organizations kept their jobs, including the leader of the one organization dedicated to promoting gay marriage and the head of the leading gay rights group in the Golden State. Well, Patrick Sammon, head of Log Cabin Republicans, did announce his retirement, but he was resigning for ...
