A Non-Judge for the Supreme Court? Most Americans Say 'No'

While a number of leading lawmakers have urged President Obama to consider a candidate for the Supreme Court who has relevant experience beyond just being a judge, an overwhelming number of Americans say the choice should be someone with a judicial background, according to a Washington Post/ABC News poll conducted April 22-25. Seventy percent said judicial credentials should be a factor in the decision with 52 percent saying it should be a "strong" factor. Only 24 percent said it should not be a factor. No other potential factors came close. Thirty-five percent favored someone with ...

Senate Committee Votes to Require Supreme Court on TV

Senate Committee Votes to Require Supreme Court on TV

A Senate committee has passed a bill requiring the U.S. Supreme Court to televise the formal arguments made before the court. Sen. Arlen Specter (D-Pa.) sponsored the bill, which passed Thursday, 13 to 6. It would require the court to televise all open sessions unless a majority of the court agrees that televising a specific case would violate due process considerations. Specter, who was the top Republican on the Judiciary Committee until he switched parties last year, has long been a proponent of cameras in the court and made his case for opening up the proceedings from the Senate floor ...

Opinion: Pick a Nominee Who Unites Americans

(April 26) -- When President Barack Obama chooses his second Supreme Court nominee, the Senate must determine the kind of justice that nominee would be. The debate about judicial nominees, after all, is really a debate about judicial power and the role federal judges are supposed to play in our system of government. One side in that debate wants judges who will rule the way they want on the issues they care about. The political ends justify the judicial means and the only thing that matters is which side wins. Judges may mangle, manipulate and manhandle the law so long as they deliver ...

Opinion: Pick a Justice Who Unites, Not Divides, America

(April 24) -- As President Barack Obama considers his second Supreme Court nominee, he faces a real dilemma. His far left base wants him to replace retiring liberal Justice John Paul Stevens with another activist judge. That's why we hear so much talk about the current court having a so-called 5-4 conservative majority, when in many cases it has a 5-4 liberal activist majority. But the political environment is drastically different now than it was when Obama nominated Justice Sonia Sotomayor. Then, Obama enjoyed record high approval ratings. Today, his numbers are inverted as more Americans ...

Supreme Court Vacancy: Obama Invites GOP to White House Meeting

Supreme Court Vacancy: Obama Invites GOP to White House Meeting

In the faint hope of making some bipartisan headway, President Barack Obama invited two top Senate Republicans to join him and Democratic leaders at the White House next week to discuss the Supreme Court vacancy opened up by the impending retirement of Justice John Paul Stevens. The White House said Senate Minority Leader Mitch McConnell and Sen. Jeff Sessions (R-Ala.) would sit down on April 21 with the president, Senate Majority Leader Harry Reid and Judiciary Chairman Patrick Leahy, (D-Vt.). Republican leaders have reacted cautiously to the Stevens vacancy, saying, in effect, they prefer ...

Justice Hillary Clinton? The Top Cases for and Against

Justice Hillary Clinton? The Top Cases for and Against

(April 12) -- Even in a town full of heady resumes, Hillary Rodham Clinton's stands out. The secretary of state is, of course, a former presidential candidate, U.S. senator and first lady. Now she may be in the running for yet another impressive seat: U.S. Supreme Court justice. At least if Sen. Orrin Hatch is to be believed. Speaking about the possible names floated to replace outgoing Justice John Paul Stevens, Hatch said on NBC's "Today" show this morning: "I even heard the name Hillary Rodham Clinton today, and that would be an interesting person in the mix. I happen to like Hillary ...

Next Supreme Court Choice Looms Large

Next Supreme Court Choice Looms Large

(April 9) -- We know what Barack Obama will be doing this summer. The president's choice of a successor to Supreme Court Justice John Paul Stevens could be one of the biggest and most politically resonating stories out of Washington this spring. The confirmation process is likely to dominate headlines until and possibly beyond the summer congressional recess. Stevens' retirement comes at a seminal moment in Obama's presidency, on the crest of political momentum from the passage of health care reform and in the looming shadow of November's midterm elections. The lifelong Supreme Court ...

After Stevens, Who Will Lead Court Liberals?

After Stevens, Who Will Lead Court Liberals?

WASHINGTON (April 5) -- Who will be the next liberal leader of the U.S. Supreme Court? As Justice John Paul Stevens strongly hinted in interviews this week that he would step down soon after more than 34 years on the high court, the question is more than merely rhetorical. Stevens turns 90 on April 20. While he could go for the record as the nation's longest-serving Supreme Court justice, he has hired only one clerk for next term instead of the usual four, a telltale sign he is considering hanging up his black robe for good. Charles Dharapak, AP Justice John Paul Stevens hinted this week ...

Court Fight Looms With Talk of Stevens' Departure

(March 17) -- President Barack Obama and Chief Justice John Roberts have been sniping at each other like in-laws with an ax to grind. And now they're potentially on the verge of a major family occasion fraught with tension. Justice John Paul Stevens turns 90 next month and is expected to announce soon whether he will retire from the Supreme Court and kick off a nomination battle for his replacement. Stevens hired only one law clerk for next fall's term instead of the usual complement of four, setting off speculation he will step down. Stevens is the leader of the closely divided court's left ...

Which Justice Loves Egg McMuffins?

Which Justice Loves Egg McMuffins?

(March 11) -- Apparently, sitting on the nation's highest court doesn't mean you give up cravings for fast food. Author Bill Geerhart reveals the guilty culinary pleasures of America's Supreme Court justices in a satirical new book titled "Little Billy's Letters." Posing as a 10-year-old boy, Geerhart wrote letters to several members of the court beginning in the early 1990s, routinely asking a series of silly questions of the justices, including "What is your favorite McDonald's food?" "I like the Egg McMuffin," responded Justice Clarence Thomas. "Actually, I like almost everything ...
