Public defender Susan Gellman, who represents defendant Phillip Garrido, made the claim during a brief hearing where Garrido and his wife and co-defendant Nancy Garrido entered not guilty pleas to kidnapping, rape and other charges contained in an amended indictment. Gellman did not elaborate on her claim ...
A 67-year-old widow struggling to feed her five grandkids may now be going to prison for Social Security fraud she claims was necessary to keep her family afloat. Mary Alice Austin lives in Detroit and has custody of her grandchildren: four from her daughter, who's battling drug addiction and couldn't care for them herself, and one child from her son, who's been in prison for the past 20 years. As a nursing home aide, her salary of $8,000 to $10,000 a year wasn't enough to cover the family's expenses. So she broke the law. Austin is being sentenced on Friday for Social Security fraud. Court ...
MADISON, Wis. -- With Republican Gov. Scott Walker's administration insisting a new law eliminating most of state workers' collective bargaining rights had gone into effect and other state and municipal leaders disputing that, many were looking to a Tuesday court hearing for some kind of clarity. The latest over the collective bargaining law began Friday when the nonpartisan Legislative Reference Bureau published the law by posting it on a website, and Walker said that was all that was needed for it to take effect. Typically, a law goes into effect when it's published by the secretary of ...

Ingmar Guandique, the Salvadoran immigrant who was convicted of killing Capitol Hill intern Chandra Levy, was sentenced today to 60 years in prison. Guandique, 29, spoke briefly through a Spanish interpreter, telling the judge he was sorry for Levy's death but that he had nothing to do with it. "I am innocent," he said. Levy, a 24-year-old Washington intern, made national headlines when she disappeared on May 1, 2001. Her body was found a year later, in the District of Columbia's Rock Creek Park. But her family had to wait many more years before they learned who killed her. Rep. ...
The New York City meteorologist accused of lying to police about being assaulted appeared in a Manhattan court today as prosecutors presented documents alleging that she faked her story for attention. Dressed in a dark dress suit, Heidi Jones briefly appeared before Criminal Court Judge Lynn Kotler with her attorney, Paul Callan. Jones said nothing as she listened to Assistant District Attorney Shanda Strain detail the case against her, which could earn her up to a year in prison. The 37-year-old WABC-TV weather anchor and occasional forecaster on "Good Morning America" went to police on ...
(Nov. 24) -- The case against Amanda Knox, imprisoned in Italy for the death of her British roommate, is taking its toll on the young American, her mother said today as the 23-year-old's high-stakes appeal of her murder conviction began in a Perugia courtroom. Her daughter puts on a "brave face" but is worried about her future, Edda Mellas said this morning on NBC's "Today" show. The appeals proceedings were adjourned until Dec. 11 after a 15-minute procedural hearing. In a trial that's drawn worldwide attention, Knox, of Seattle, was convicted in December of murder and sexual assault in ...
(Nov. 3) -- The hiccups that gave "Hiccup Girl" Jennifer Mee her first 15 minutes of fame returned during a court hearing for the 19-year-old, who has been charged with first-degree murder. Prosecutors say Mee lured 22-year-old Shannon Griffin to a home where two other suspects robbed him at gunpoint. He was then shot to death. At a bond hearing Tuesday in a Pinellas County, Fla., courtroom, Mee wept as Griffin's cousin, Doug Bolden, testified that Griffin had been looking forward to meeting Mee for a date. "Next thing I know, that Saturday, he's smiling, saying he's going to meet a girl," ...
(Sept. 10) -- A federal judge in Riverside, Calif., has ruled that the U.S. military's ban on openly gay service personnel is unconstitutional, declaring that the so-called "don't ask, don't tell'' policy violates the First and Fifth Amendment rights of lesbians and gay men. In her ruling, U.S. District Judge Virginia Phillips said that Justice Department attorneys had failed to prove that the policy "significantly furthers government interests in military readiness or troop cohesion, or that discharge is necessary to those interests." By contrast, Phillips noted that booting homosexuals ...
(Aug. 25) -- There's a certain kind of fan who resents modern professional athletes, not because of the vast amounts of money they make, but because they don't seem to hate their rivals. Take "The Decision" for example. Soon after LeBron James announced his decision to join up with fellow stars Dwyane Wade and Chris Bosh, retired players such as Magic Johnson said they would have never made such a move. Johnson said he spent his time thinking of how he could beat Larry Bird, not join forces with him. These days, NBA stars are more likely to embrace on the court than throw a malicious ...
