Senior U.S. District Judge Roger Vinson agreed with the states that the new law violates people's rights by forcing them to buy health insurance by 2014 or face penalties. He went a step further than a previous ruling against the law, declaring the entire thing unconstitutional if the insurance requirement does not hold up. Attorneys for the administration had argued that the states did not ...
Today U.S. District Judge Roger Vinson ruled that President Obama's health care reform law is unconstitutional because of a provision that requires individuals to purchase health insurance. Twenty-six states were party to the suit, claiming that the insurance mandate violates constitutional law. Because Democrats did not write a severability clause into the health care act, the entire legislation may be challenged by the unconstitutionality of certain provisions. Andrew Cohen at The Atlantic notes that today's ruling is a lower-court decision that won't determine the ultimate fate of the ...
U.S. District Judge Roger Vinson struck down President Barack Obama's signature health care law today, arguing that it violated the U.S. Constitution. Siding with the argument made by lawyers representing 26 U.S. states, Vinson specifically took issue with provisions of the law that require citizens to purchase health insurance. The matter will now head to the United States Supreme Court, where it faces an uncertain fate. Measly wages and non-existent benefits have become the norm for many workers employed overseas. However, one fair trade company in Thailand is determined to raise those standards and give their employees a better, brighter way of life. Pure & Co. is a company that specializes in hand-sewn knitwear and other hand-made garments through their Pure Handknit and Neon Buddha clothing lines. The company operates globally, employing 5,000 people -- mostly women -- across Canada, the U.S. and Thailand who produce knitwear that's sold in 2,000 independent boutiques around America and in Nordstrom, ...
House Speaker John Boehner said he wanted to be "the most pro-life speaker ever" and on Thursday the Ohio Republican showed how he plans do that by hailing new bills aimed at barring federal funds from paying for abortions. The most ambitious legislation is the "No Taxpayer Funding for Abortion Act," a measure that again reprises the health care reform battle from the last Congress when disputes over abortion funding played a crucial role. Only this new bill would go further than anything ever considered by Congress because it would make the so-called Hyde Amendment permanent and applicable ...
Well, that didn't take long. Almost immediately after the House voted to repeal Obama's health care law, a liberal-leaning nonprofit called the Public Campaign Action Fund announced it would air TV ads targeting a group of potentially vulnerable freshmen Republicans. The ads will air in the districts of Jim Renacci (R-Ohio), Jon Runyan (R-N.J.) and Tim Walberg (R-Mich.). "These three members of Congress sided with the insurance companies and their donors, and against their constituents yesterday," said David Donnelly, national campaigns director for Public Campaign Action Fund. "They were ...
WASHINGTON -- House Republicans voted overwhelmingly Wednesday to repeal the historic health care reform law in a largely symbolic exercise to appease the tea party movement and keep a campaign promise that helped them retake the majority in November. The 245 to 189 vote fell sharply along party lines. No Republicans voted against the bill. Three Democrats voted to repeal the law. Even as lawmakers cast their votes on the provocatively named "Repealing the Job-Killing Health Care Law Act," the measure was as good as dead. Senate Majority Leader Harry Reid called it, "nothing more than ...
A report that says nearly half of all non-elderly Americans are at risk of losing their health insurance coverage thanks to a pre-existing condition is enough to get anyone's attention -- even when it's part of a White House political campaign to undermine the Republicans' health care reform repeal effort. But that's the finding of an analysis from the Department of Health and Human Services, which concludes that "129 million people could be denied affordable coverage without health reform." That's because, the report says, between 50 million and 129 million non-elderly Americans have a ...
After a weeklong reprieve from partisan battles, Democrats and Republicans returned to the floor of the House on Tuesday to debate the repeal of the health care reform law. The new bill, due for a vote in the House on Wednesday, is officially known as the "Repealing the Job-Killing Health Care Law Act," and is largely seen as a symbolic gesture. It stands little chance of coming before the Senate for a vote -- where a Democratic majority is firmly in place -- and it faces the threat of a presidential veto should it actually pass both houses. City workers in Berkeley, Calif., who want sex-change surgery, won't get money from their health insurance providers, but they could soon receive funding for the procedure from taxpayers. The City Council votes Tuesday night on a resolution to set aside $20,000 annually for gender-reassignment surgery for city employees, The San Francisco Chronicle reported. The procedure is not covered by Berkeley's health insurance providers, Kaiser and Health Net. To receive the benefit, workers would be required to be employed by the city for at least a year. They would also have to live as the opposite ...
