NY Judge: 4-Year-Old Can Be Sued for Bike Accident

(Oct. 29) -- A little girl who allegedly drove her bicycle into an elderly woman when she was 4 can be sued for negligence, a New York judge has ruled. Juliet Breitman was 4 years old in April 2009 when she allegedly raced her bicycle -- still fitted with training wheels -- into 87-year-old Claire Menagh in Manhattan. The woman suffered a hip fracture that required surgery; she died a few weeks later, according to The New York Times. Courts have ruled that children under the age of 4 cannot be held legally liable. But Justice Paul Wooten of the State Supreme Court in Manhattan said that ...

Elena Kagan's First Day: Fast Start, Early Out

(Oct. 4) -- The Kagan has been released! Elena Kagan, the newest member of the U.S. Supreme Court, waited approximately 15 minutes into her first case as an active jurist today before asking a question. The case, Ransom v. MBNA, involves bankruptcy law and marks Kagan's entry onto the ideologically divided Supreme Court bench. Following questions from Justices Samuel Alito, Ruth Bader Ginsburg, Antonin Scalia and Stephen Breyer, Kagan waded into her new career by asking a lawyer for Jason Ransom why his client, who owed $82,000 in credit card debt, should be allowed to shield his monthly ...

Calif. Judge Rules Military's Ban on Gays Unconstitutional

(Sept. 10) -- A federal judge in Riverside, Calif., has ruled that the U.S. military's ban on openly gay service personnel is unconstitutional, declaring that the so-called "don't ask, don't tell'' policy violates the First and Fifth Amendment rights of lesbians and gay men. In her ruling, U.S. District Judge Virginia Phillips said that Justice Department attorneys had failed to prove that the policy "significantly furthers government interests in military readiness or troop cohesion, or that discharge is necessary to those interests." By contrast, Phillips noted that booting homosexuals ...

Prop 8 Judge's Personal Life Debated After Ruling

SAN FRANCISCO (Aug. 6) -- The federal judge who overturned California's same-sex marriage ban this week is a Republican who once came under fire for his membership to a powerful all-male club that had only recently allowed blacks to join. But after Chief U.S. Judge Vaughn Walker struck down the voter-approved ban known as Proposition 8, he became something else in the minds of some: a gay activist. Rumors have circulated for months that Walker is gay, fueled by the blogosphere and a San Francisco Chronicle column that stated his sexual orientation was an "open secret" in legal and gay ...

Critics of Prop 8 Ruling Make Judge's Sexual Orientation an Issue

(Aug. 5) -- Critics of "activist judges," start your engines! A developing subplot to Wednesday's ruling by U.S. District Court Judge Vaughn Walker that overturned California's Proposition 8, which prohibited same-sex marriage, is that Walker is himself reported to be gay. During the case, articles in publications ranging from the San Francisco Chronicle to the conservative website World Net Daily raised the issue of how Walker's sexuality would, or would not, affect his decision. After Wednesday's outcome, the topic bubbled up again. An editorial on the website My Auburn California ...

Dozens Arrested at Protests of Arizona Immigration Law

PHOENIX (July 29) -- Opponents of Arizona's immigration crackdown went ahead with protests Thursday despite a judge's ruling that delayed enforcement of most of the law, and about 50 people in Phoenix were arrested after peacefully confronting officers in riot gear. Gov. Jan Brewer called U.S. District Judge Susan Bolton's Wednesday's decision halting the law "a bump in the road," and her spokesman said they'd appeal to the 9th U.S. Circuit Court of Appeals in San Francisco later Thursday. Outside the state Capitol, hundreds of protesters began marching at dawn, gathering in front of the ...
