Repealing 'Don't Ask, Don't Tell': Congress Takes the Issue Back From Judges

Saturday's Congressional repeal of the law supporting the U.S. military's "Don't Ask, Don't Tell" ban on openly gay or lesbian service members will ultimately render moot the many legal challenges to it that have cropped up all around the country. Supreme Court Lets 'Don't Ask, Don't Tell' Stand

Supreme Court Lets 'Don't Ask, Don't Tell' Stand

(Nov. 12) -- The Supreme Court ruled that the United States can continue to enforce the "don't ask, don't tell" policy that requires gays in the military to keep their sexual orientation private. The court denied a request from a gay rights group, the Log Cabin Republicans, that asked the court to intervene in the law's enforcement, according to The Associated Press. The court did not comment on the case. A federal judge ruled last month that the policy violated the rights of gay Americans and issued an injunction that bars the Pentagon from enforcing it. Still, the San Francisco appeals ...

Supreme Court Allows Gay Military Ban for Now

WASHINGTON (Nov. 12) -- The Supreme Court on Friday allowed the "don't ask, don't tell" policy on gays in the military to remain in place while a federal appeals court considers the issue. The court did not comment in denying a request from the Log Cabin Republicans, a gay rights group, to step into the ongoing federal court review of "don't ask, don't tell." The Obama administration urged the high court not to get involved at this point. Last month, a federal judge ruled that the policy violates the civil rights of gay Americans and she issued an injunction barring the Pentagon from ...

Is the GOP in the Closet About Backing Gay Rights?

Is the GOP in the Closet About Backing Gay Rights?

WASHINGTON (Oct. 13) -- A federal judge's order to halt enforcement of the military's "don't ask, don't tell" policy was hailed by gay activists as a landmark ruling in their struggle to expand their rights. But something else made the case significant: The group that filed the lawsuit was the Log Cabin Republicans, a gay advocacy organization. And the policy U.S. District Judge Virginia Phillips ruled unconstitutional? It was the brainchild of the Democratic president, Bill Clinton, who nominated her. Seventeen years after Clinton hashed out a compromise with conservatives that has led to ...

End of 'Don't Ask, Don't Tell'? It Depends on Obama

End of 'Don't Ask, Don't Tell'? It Depends on Obama

(Oct. 13) -- At any point during his first two years of office, President Barack Obama could have ended, unilaterally, "don't ask, don't tell," the ban on gays openly serving in the military. All it would have taken was an executive order. But he didn't. Instead, it's been ended -- at least temporarily -- by U.S. District Judge Virginia Phillips, who was appointed to the federal court by Bill Clinton, the president who introduced the policy in 1993. Phillips ruled that don't ask, don't tell violated the First Amendment, which guarantees the right to free speech, and the Fifth Amendment, ...

Calif. Judge Rules Military's Ban on Gays Unconstitutional

Calif. Judge Rules Military's Ban on Gays Unconstitutional

(Sept. 10) -- A federal judge in Riverside, Calif., has ruled that the U.S. military's ban on openly gay service personnel is unconstitutional, declaring that the so-called "don't ask, don't tell'' policy violates the First and Fifth Amendment rights of lesbians and gay men. In her ruling, U.S. District Judge Virginia Phillips said that Justice Department attorneys had failed to prove that the policy "significantly furthers government interests in military readiness or troop cohesion, or that discharge is necessary to those interests." By contrast, Phillips noted that booting homosexuals ...

Ken Mehlman Owes Gays an Apology, Says Gay Activist Who Outed Him

Ken Mehlman Owes Gays an Apology, Says Gay Activist Who Outed Him

(Aug. 26) -- It's unclear how ex-Republican National Committee Chair Ken Mehlman's statement acknowledging, after years of denials, that he's gay will sit with the gay community (and non-gay advocates for gay rights). Mehlman says he came out of the closet because he wants to work for gay marriage rights, something he didn't do -- at least publicly -- while working closely with President George W. Bush. Despite the buzz now surrounding Mehlman's announcement, his sexuality was not a secret (witness Bill Maher alleging as much on "Larry King Live" in 2006). In fact, blogger Mike Rogers outed ...

Opinion: New Approach Needed to Advance Gay Rights

(Dec. 3) - In the immediate aftermath of the passage of California's Proposition 8 last fall -- where voters amended the state's constitution to recognize only marriages between one man and one woman -- there was a lot of finger-pointing in the gay community, but no bloodletting. Leaders of all the major gay organizations kept their jobs, including the leader of the one organization dedicated to promoting gay marriage and the head of the leading gay rights group in the Golden State. Well, Patrick Sammon, head of Log Cabin Republicans, did announce his retirement, but he was resigning for ...

GOP's Secret Weapon: Tolerance

GOP's Secret Weapon: Tolerance

As hard as it is to imagine the party of George Bush and Karl Rove transitioning into cheerleaders at a gay pride parade, it looks like we're headed there. A recent Gallup poll shows that a majority of Americans favor openly gay and lesbian soldiers in the military. And it's not a slim majority, either. ...

Republican Candidates Clash Over Who Hates Gays the Most

Republican Candidates Clash Over Who Hates Gays the Most

Today is election day for the Republican Party. One of six highly entertaining candidates will soon be named the next party chairman, hoping to do for the GOP what Jim Clymer has done for the Constitution Party.[Update: There are now only five candidates for the post. Former Tennessee party chairman Chip Saltsman has dropped out for the unpardonable sin of e-mailing hippie music to Republicans.]But it turns out that there's a transgression out there that's even worse than Saltsman's. Rumor has it - and by "rumor" we mean Michigan GOP chairman Saul Anuzis, a candidate for the job - that ...
