Judge's Gay Partner Raised in Proposition 8 Appeal

SAN FRANCISCO -- Proponents of California's same-sex marriage ban filed a motion Monday asking that the historic ruling be overturned because the federal judge who struck down Proposition 8 was in a long-term relationship with another man. Lawyers for the ban's backers said in the motion in San Francisco's U.S. District Court that Chief U.S. District Judge Vaughn Walker should have removed himself from the case, or at least disclosed his relationship status, because his "impartiality might reasonably be questioned." New York Allows Same-Sex Conjugal Visits in State Prisons

New York inmates who are in same-sex marriages or civil unions are being allowed conjugal visits with their spouses or partners. The state officially announced the change in policy last week, making New York one of the few states to grant the private visits for gay and lesbian inmates in legally recognized same-sex partnerships. Although the policy will directly affect a relatively small number of people, advocates for same-sex marriage say it's an important step toward full equality for gay and lesbian couples. "This is a recognition of same-sex couples as families," Molly McKay of Marriage ...

Zach Wahls' Iowa Speech for Gay Marriage Goes Viral [VIDEO]

The Iowa House of Representatives approved a resolution on Tuesday that proposes a constitutional amendment to ban same-sex marriage in the state. Hundreds of people packed the Iowa State House to debate the issue -- known as House Joint Resolution 6 -- which passed by a 62-37 vote. One of the individuals who spoke was Zach Wahls, a University of Iowa engineering student and the child of a same-sex couple. His three-minute speech against the resolution is going viral across the Internet, much like Fort Worth, Texas, City Councilman Joel Burns' "It Gets Better" speech did during ...

Gay Couple Separated by Deportation Fight for Legal Status

Every day before he left for work, Richard Dennis would kiss his partner on the forehead as he slept, knowing each kiss could be their last. That's because Dennis' partner, Jair Izquierdo, was in the United States illegally and the pair's civil union wasn't recognized by the federal government. So the New York couple of more than five years lived their lives in constant fear that Izquierdo, a Peruvian citizen who had overstayed his visa, would be deported. Then, in October, it happened. Izquierdo, 33, was at his job as a cosmetician at a hair salon in New York's East Village on Oct. 20 when ...

Televised Gay Marriage Hearing Draws Wide Audience

SAN FRANCISCO (Dec. 6) -- The legal fight over California's gay marriage ban went before a federal appeals court Monday in a hearing that reached a nationwide TV audience anxious for a final decision on whether the measure violates the U.S. Constitution. The hearing before a three-judge panel of the 9th U.S. Circuit Court of Appeals also focused on whether supporters of voter-approved Proposition 8 have legal standing to challenge a lower court ruling that the ban was unconstitutional. The judges did not issue an immediate ruling and no timetable has been set. Jeff Chiu, AP From left, ...

Legally Married Gay Man Faces US Deportation

Legally Married Gay Man Faces US Deportation

(Oct. 27) -- Henry Velandia is married to a U.S. citizen, but he might be deported anyway. That's because the Venezuelan-born salsa teacher's legal same-sex marriage in Connecticut isn't recognized by the federal government. So his husband -- Josh Vandiver, a Princeton University doctoral student from Colorado -- can't sponsor him for residency the way he could in a heterosexual marriage. The New Jersey couple of four years say the Defense of Marriage Act, which legally defines marriage as a union between a man and a woman, could force them to leave the country. Yiftah Elazar, ...

National Coming Out Day 2010: News Roundup

(Oct. 11) -- Move over Columbus Day; today is National Coming Out Day. Established in 1988, the lesbian, gay, bisexual and transgender rights awareness day is being celebrating on college campuses and in communities across the country. This year, the LGBT community and straight supporters -- through Human Rights Campaign support under the National Coming Out Project -- are approaching the national day of civil awareness in light of recent tragic instances of sexuality-related bullying (such as the Tyler Clementi suicide) and other allegedly anti-gay attacks. Despite its name, National ...

After a Dissent, Mormon Leaders Reaffirm Stance Against Gay Marriage

(Oct. 4) -- Last month, a senior leader of the Church of Jesus Christ of Latter-day Saints apologized for the Mormon church's involvement in California's campaign in favor of Proposition 8, the ballot initiative that outlaws gay marriage. "On the morning of Sunday, September 19, about ninety members of the Oakland, California stake (diocese) of the Church of Jesus Christ of Latter-day Saints met with Elder Marlin K. Jensen, the Church's historian and a prominent member of the General Authorities, the ranking hierarchy of Mormon leaders," reports Joanna Brooks of Religion Dispatches magazine. ...

Walker, Judge Who Overturned Proposition 8, to Retire

(Sept. 30) -- The federal judge who struck down California's same-sex marriage ban is retiring, his court has announced. U.S. District Judge Vaughn Walker, the chief judge for the U.S. District Court Northern District of California, will return to the private sector at the end of the year. Walker, a Republican appointed by former President George H.W. Bush, ruled in August that California's voter-approved Proposition 8 defining marriage as a union between a man and woman was unconstitutional. "Proposition 8 fails to advance any rational basis in singling out gay men and lesbians for denial ...

Florida Gay Adoption Ban Overturned, but 3 States Still Restrict It

(Sept. 22) -- For the past 33 years, the state of Florida has officially banned gay and lesbian couples from adopting children. Today, however, a court of appeals sided with a lower court and ruled that such restrictions were unconstitutional. The case, which was brought by a gay couple, will now likely head to the Florida Supreme Court, the Miami Herald reported. A 2009 Quinnipiac poll found that 55 percent of the state's residents favor doing away with the ban on gay adoption, while 39 percent of those questioned said they would keep it in place. If Florida's law, which is the only one ...
